CMS Recognizes the Right of All Medicaid Beneficiaries to NEMT

Simon&Co is pleased to note the codification of non-emergency medical transportation (NEMT) into law, thanks to a 10-year campaign by over 60 Medicaid advocates from across the country. On July 12, the Centers for Medicare and Medicaid Services (CMS) released a Center Informational Bulletin (CIB) that provides details on section 209 of the Consolidated Appropriations Act, 2021, requiring Medicaid coverage of NEMT for all medically necessary services. This section codifies into law the longstanding CMS regulation requiring states to “assure necessary transportation for beneficiaries to and from covered services.”
