On February 15th, Representatives Sanford Bishop (D-GA), Tony Cárdenas (D-CA) and Buddy Carter (R-GA), sent a letter to HHS Secretary Xavier Becerra, requesting the agency follow through on providing alternative non- emergency medical transportation (NEMT) to full and partial dual eligibles who have lost access to dialysis due to CMS’ new prior authorization policy for Medicare Ambulance NEMT. The Consolidated Appropriations Act of 2023, enacted December 29, 2022, directs CMS to provide “a plan within 90 days of enactment … to provide alternative transportation to the low-income Medicare-Medicaid full and partial dual eligibles who have no alternative transportation to dialyses and diabetes related wound care service.” The letter reiterates the April deadline and states that if it is not met, Representatives Bishop, Cárdenas, and Carter, plan to reintroduce the Access to Critical Non-Emergency Transportation Services Act, H.R. 8841, to address the shortfalls of the RSNAT model prior authorization policy.
